Terms of Service

The terms governing use of ACF certification services, the public registry, and acfstandards.org.

Effective date: January 1, 2026 · Governing law: Texas, United States

1. Acceptance

By submitting an agent for ACF certification or using any ACF service, you agree to these Terms of Service. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to these terms. These terms should be read alongside the Operator Registration Agreement (ORA-2026-v1.0) for registered operators.

2. The ACF certification service

ACF provides independent behavioral certification of AI agents. Certification represents a point-in-time assessment of a specific agent version under specified operating conditions. ACF does not guarantee that a certified agent will perform identically in all deployment contexts, nor that certification will prevent all possible behavioral failures.

3. Operator obligations

  • Provide accurate and complete information at submission
  • Initiate recertification following any material change to the certified agent, as defined in the Operator Registration Agreement
  • Not misrepresent certification status or scope in any public communication
  • Not use ACF marks or registry IDs for agents that have not been certified or whose certification has lapsed
  • Not attempt to manipulate, circumvent, or reverse-engineer ACF test methodology

4. Registry and certificate use

Operators are granted a non-exclusive license to display their ACF certificate and reference their registry listing in marketing materials, product documentation, and sales conversations, provided the representation is accurate and not misleading. ACF reserves the right to revoke certification and remove registry listings for violations of these terms.

5. Limitation of liability

ACF certification does not constitute legal advice, regulatory compliance certification (except as specifically stated in module documentation), or a warranty of the agent's performance. To the maximum extent permitted by applicable law, ACF's liability for any claim arising from certification services is limited to the fees paid by the operator for the specific certification at issue.

6. Certification revocation

ACF may revoke a certificate if: the operator provided materially false information at submission; the certified agent has been materially modified without recertification; the operator is in material breach of the Operator Registration Agreement; or the certificate was issued in error. Revoked certificates are marked in the registry and the operator is notified with a written explanation.

7. Dispute resolution

Disputes arising from certification outcomes must first be submitted to ACF's internal appeal process. An operator may request a re-review of specific failed tests within 30 days of receiving a score report. ACF will issue a written decision within 14 business days. If unresolved, parties agree to binding arbitration under the American Arbitration Association Commercial Arbitration Rules in Texas.

8. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

9. Changes

We may update these terms with 30 days' advance notice to registered operators. Continued use of ACF services after the effective date constitutes acceptance.
